                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the use of a motor vehicle by a peace officer in
    1-3  pursuit of a person.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 2, Code of Criminal Procedure, is amended
    1-6  by adding Article 2.131 to read as follows:
    1-7        Art. 2.131.  LIMITATION ON USE OF MOTOR VEHICLE.  A peace
    1-8  officer is justified in pursuing a person by motor vehicle at
    1-9  speeds that are not reasonable and safe under the conditions
   1-10  existing at the time and place of pursuit only if the officer
   1-11  reasonably believes pursuit at those speeds is immediately
   1-12  necessary to arrest a person engaged in the commission of a felony
   1-13  offense other than theft of a motor vehicle or an offense under
   1-14  Section 31.07, Penal Code.
   1-15        SECTION 2.  The importance of this legislation and the
   1-16  crowded condition of the calendars in both houses create an
   1-17  emergency and an imperative public necessity that the
   1-18  constitutional rule requiring bills to be read on three several
   1-19  days in each house be suspended, and this rule is hereby suspended.
