A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the board of directors of the Harris-Galveston Coastal
1-3 Subsidence District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 151.031(a) and (b), Water Code, are
1-6 amended to read as follows:
1-7 (a) The district is governed by a board of directors
1-8 composed of 19 <17> members who serve for two-year, staggered
1-9 terms.
1-10 (b) The board consists of:
1-11 (1) six members from the city in the district having
1-12 the largest population of any city in the district, to be appointed
1-13 by the mayor of that city, one of these members to be a
1-14 representative of industry;
1-15 (2) one member from the city in the district having
1-16 the next largest population of any city in the district, to be
1-17 appointed by the mayor of that city;
1-18 (3) two members from all incorporated cities in
1-19 Galveston County, appointed by the mayors of those cities;
1-20 (4) one member from the city of Baytown, appointed by
1-21 the mayor of that city;
1-22 (5) three <two> members appointed by the commissioners
1-23 court of Harris County, one to be a representative of agriculture,
1-24 <and> one to be a representative of industry, and one to be a
2-1 representative of municipal utility districts, provided that none
2-2 <neither> of these members is a resident of the city in the
2-3 district having the largest population, and provided that the
2-4 representative of municipal utility districts is a resident of a
2-5 municipal utility district in the district;
2-6 (6) three <two> members appointed by the commissioners
2-7 court of Galveston County, one to be a representative of municipal
2-8 utility districts, provided that the representative of municipal
2-9 utility districts is a resident of a municipal utility district in
2-10 the district;
2-11 (7) one member from Harris County chosen by the mayors
2-12 of the cities of Deer Park, Galena Park, La Porte, Nassau Bay, and
2-13 Seabrook and the president of the Clear Lake City Water Authority;
2-14 (8) one member from Harris County chosen by the mayors
2-15 of the cities of West University Place, Southside Place, Bellaire,
2-16 and Jacinto City; and
2-17 (9) one member from Harris County chosen by the mayors
2-18 of the cities of Humble, Piney Point Village, Hedwig Village,
2-19 Bunker Hill Village, Hunters Creek Village, Hilshire Village, and
2-20 the village of Spring Valley.
2-21 SECTION 2. (a) Not later than the 30th day after the
2-22 effective date of this Act, the general manager of the
2-23 Harris-Galveston Coastal Subsidence District shall call and hold a
2-24 meeting at the district's main office for the selection of the two
2-25 additional directors added to the board of directors of the
2-26 district by this Act. The general manager shall mail written
2-27 notice of the time, place, and purpose of the meeting to each
3-1 commissioners court designated in Sections 151.031(b)(5) and (6),
3-2 Water Code, to choose the additional directors. The notice must be
3-3 sent by certified mail, return receipt requested, not later than
3-4 the 10th day before the date set for the meeting.
3-5 (b) The initial new directors appointed under Sections
3-6 151.031(b)(5) and (6), Water Code, as amended by this Act, serve
3-7 until January 31, 1996. Subsequent directors shall be selected to
3-8 fill those positions in the manner and for the terms provided by
3-9 law for selection of other members of the board of directors of the
3-10 Harris-Galveston Coastal Subsidence District whose terms expire in
3-11 even-numbered years.
3-12 SECTION 3. The importance of this legislation and the
3-13 crowded condition of the calendars in both houses create an
3-14 emergency and an imperative public necessity that the
3-15 constitutional rule requiring bills to be read on three several
3-16 days in each house be suspended, and this rule is hereby suspended,
3-17 and that this Act take effect and be in force from and after its
3-18 passage, and it is so enacted.
