No. 1318 1-2 (In the Senate - Received from the House March 22, 1995; 1-3 March 23, 1995, read first time and referred to Committee on 1-4 Natural Resources; April 20, 1995, reported favorably by the 1-5 following vote: Yeas 8, Nays 0; April 20, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to an exemption from the sand and gravel permitting 1-9 process for disturbances of marl, sand, gravel, shell, and mudshell 1-10 for noncommercial maintenance projects by public utilities. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Chapter 86, Parks and Wildlife Code, is amended 1-13 by adding Section 86.0191 to read as follows: 1-14 Sec. 86.0191. EXEMPTION. The commission shall, by rule, 1-15 exempt entities from the requirements of this chapter regarding 1-16 permits and fees required for disturbing or taking marl, sand, 1-17 gravel, shell, and mudshell for noncommercial purposes when such 1-18 disturbances or takings occur for maintenance projects carried out 1-19 by public utilities. 1-20 SECTION 2. This Act takes effect September 1, 1995. 1-21 SECTION 3. The importance of this legislation and the 1-22 crowded condition of the calendars in both houses create an 1-23 emergency and an imperative public necessity that the 1-24 constitutional rule requiring bills to be read on three several 1-25 days in each house be suspended, and this rule is hereby suspended. 1-26 * * * * *
