                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the effective date of rules adopted by the State Board
    1-3  of Education.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.24, Education Code, is amended by
    1-6  adding Subsection (c) to read as follows:
    1-7        (c)  Unless otherwise specifically provided by statute, a
    1-8  rule adopted by the board does not take effect until the beginning
    1-9  of the school year that begins at least 90 days after the date the
   1-10  rule would take effect under the generally applicable effective
   1-11  date prescribed by Section 2001.036(a), Government Code.
   1-12        SECTION 2.  Section 11.52, Education Code, is amended by
   1-13  adding Subsection (r) to read as follows:
   1-14        (r)  Unless otherwise specifically provided by statute, a
   1-15  rule adopted by the commissioner does not take effect until the
   1-16  beginning of the school year that begins at least 90 days after the
   1-17  date the rule would take effect under the generally applicable
   1-18  effective date prescribed by Section 2001.036(a), Government Code.
   1-19        SECTION 3.  This Act takes effect September 1, 1995.
   1-20        SECTION 4.  Sections 11.24(c) and 11.52(r), Education Code,
   1-21  as added by this Act, apply only to a rule that is not finally
   1-22  adopted before September 1, 1995.
   1-23        SECTION 5.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
