A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to road construction, repair, and maintenance in certain
1-3 areas controlled by the Parks and Wildlife Department.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 1.02, Chapter 7, Acts of the 72nd
1-6 Legislature, 1st Called Session, 1991, is amended to read as
1-7 follows:
1-8 Sec. 1.02. Notwithstanding any other law, the Texas
1-9 Department of Transportation shall construct, repair, and maintain
1-10 roads in and adjacent to state parks, state fish hatcheries, state
1-11 wildlife management areas, and support facilities for parks, fish
1-12 hatcheries, and wildlife management areas. Where the Parks and
1-13 Wildlife Department has no easement, right-of-way, or similar
1-14 access to or in a state park, state fish hatchery, state wildlife
1-15 management area, or support facility, none may be obtained
1-16 hereunder without the express written consent of all affected
1-17 private landowners. Any private land required for right-of-way
1-18 purposes shall be acquired by the Department of Transportation.
1-19 Construction, maintenance, repairs or acquisition made under this
1-20 section shall be paid from the State Highway Fund.
1-21 SECTION 2. This Act takes effect September 1, 1995.
1-22 SECTION 3. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
