    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to road construction, repair, and maintenance in certain
    1-9  areas controlled by the Parks and Wildlife Department.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  Section 1.02, Chapter 7, Acts of the 72nd
   1-12  Legislature, 1st Called Session, 1991, is amended to read as
   1-13  follows:
   1-14        Sec. 1.02.  Notwithstanding any other law, the Texas
   1-15  Department of Transportation shall construct, repair, and maintain
   1-16  roads in and adjacent to state parks, state fish hatcheries, state
   1-17  wildlife management areas, and support facilities for parks, fish
   1-18  hatcheries, and wildlife management areas.  Where the Parks and
   1-19  Wildlife Department has no easement, right-of-way, or similar
   1-20  access to or in a state park, state fish hatchery, state wildlife
   1-21  management area, or support facility, none may be obtained
   1-22  hereunder without the express written consent of all affected
   1-23  private landowners.  Any private land required for right-of-way
   1-24  purposes shall be acquired by the Department of Transportation.
   1-25  Construction, maintenance, repairs or acquisition made under this
   1-26  section shall be paid from the State Highway Fund.
   1-27        SECTION 2.  This Act takes effect September 1, 1995.
   1-28        SECTION 3.  The importance of this legislation and the
   1-29  crowded condition of the calendars in both houses create an
   1-30  emergency and an imperative public necessity that the
   1-31  constitutional rule requiring bills to be read on three several
   1-32  days in each house be suspended, and this rule is hereby suspended.
