No. 1454 1-2 (In the Senate - Received from the House May 10, 1995; 1-3 May 11, 1995, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 17, 1995, reported favorably, as 1-5 amended, by the following vote: Yeas 10, Nays 0; May 17, 1995, 1-6 sent to printer.) 1-7 COMMITTEE AMENDMENT NO. 1 By: Patterson 1-8 Amend H.B. 1454 by adding a new subsection (b) to read as 1-9 follows and relettering subsequent sections: 1-10 "(b) The trustee shall identify the true owner of the 1-11 property to a municipality or county." 1-12 A BILL TO BE ENTITLED 1-13 AN ACT 1-14 relating to requirements for certain political subdivisions that 1-15 acquire real property held in trust. 1-16 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-17 SECTION 1. Chapter 280, Local Government Code, is amended by 1-18 adding Section 280.002 to read as follows: 1-19 Sec. 280.002. ACQUIRING LAND HELD IN TRUST. (a) A 1-20 municipality or county may not purchase real property held in trust 1-21 until the trustee submits to the governing body of the municipality 1-22 or county a copy of the trust agreement identifying the true owner 1-23 of the property. 1-24 (b) A conveyance of property by a trustee is void if a 1-25 municipality or county fails to comply with Subsection (a). 1-26 (c) A trust agreement submitted to the governing body of the 1-27 municipality or county under this section is confidential 1-28 information excepted from the requirements of Section 552.021, 1-29 Government Code. 1-30 SECTION 2. The importance of this legislation and the 1-31 crowded condition of the calendars in both houses create an 1-32 emergency and an imperative public necessity that the 1-33 constitutional rule requiring bills to be read on three several 1-34 days in each house be suspended, and this rule is hereby suspended. 1-35 * * * * *
