A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the tuition charged to certain nonresident students at
1-3 certain public technical institutes.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 54.060(a), Education Code, is amended to
1-6 read as follows:
1-7 (a) The nonresident tuition fee prescribed in this chapter
1-8 does not apply to a nonresident student who is a resident of
1-9 Arkansas, Louisiana, New Mexico, or Oklahoma and who registers in
1-10 any Texas public junior college, as defined by Section 61.003 of
1-11 this code, or at any campus or extension center of a public
1-12 technical institute, as defined by Section 61.003 of this code,
1-13 that is situated in a county immediately adjacent to the state in
1-14 which the nonresident student resides. The nonresident tuition fee
1-15 prescribed in this chapter does not apply to a nonresident student
1-16 who is a resident of New Mexico or Oklahoma and who registers at a
1-17 campus or extension center of <in> a public technical institute
1-18 that is situated in a county that is within 100 miles of the state
1-19 in which the nonresident student resides and who is admitted for
1-20 the purpose of utilizing available instructional facilities. A
1-21 <The> nonresident junior college <or public technical institute>
1-22 student described in this section shall pay an amount equivalent to
1-23 the amount charged a Texas student registered at a similar school
1-24 in the state in which the nonresident student resides. A
2-1 nonresident public technical institute student described in this
2-2 section shall pay the same tuition fee that the student would pay
2-3 if the student were a resident of this state. A <The> nonresident
2-4 student described in this section shall pay equivalent fees and
2-5 charges to those charged Texas students registered at a similar
2-6 institution in the state in which the nonresident student resides,
2-7 when such student registers at a Texas public senior upper level
2-8 (those institutions offering only junior, senior, and graduate
2-9 level programs) institution of higher education located within the
2-10 Texas public junior college district or within the county in which
2-11 the campus or extension center of the public technical institute is
2-12 located or adjacent to such county and from which the nonresident
2-13 student has graduated or completed 45 semester credit hours.
2-14 SECTION 2. This Act applies beginning with tuition imposed
2-15 for the fall 1995 semester.
2-16 SECTION 3. The importance of this legislation and the
2-17 crowded condition of the calendars in both houses create an
2-18 emergency and an imperative public necessity that the
2-19 constitutional rule requiring bills to be read on three several
2-20 days in each house be suspended, and this rule is hereby suspended,
2-21 and that this Act take effect and be in force from and after its
2-22 passage, and it is so enacted.
