1-7 A BILL TO BE ENTITLED
1-8 AN ACT
1-9 relating to the juvenile board of Mitchell County.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 152.1741, Human Resources Code, is
1-12 amended by amending Subsections (a), (b), and (c) and adding
1-13 Subsections (f) and (g) to read as follows:
1-14 (a) Mitchell County is included in the Fisher, Mitchell, and
1-15 Nolan counties juvenile board. The juvenile board is composed of:
1-16 (1) a <the> county judge from <judges and the district
1-17 judges in> Fisher, Mitchell, or <and> Nolan County elected by a
1-18 majority vote of the county judges from those counties <Counties>;
1-19 (2) the 32nd Judicial District judge or the judge of
1-20 the county court at law in Nolan County who is selected by
1-21 agreement between those two judges;
1-22 (3) one person <two persons> appointed by the Nolan
1-23 County Commissioners Court;
1-24 (4) subject to Subsection (f), the city manager of
1-25 Sweetwater or another person <two persons> appointed by the
1-26 Sweetwater City Commission;
1-27 (5) subject to Subsection (g), the superintendent of
1-28 the Sweetwater Independent School District or another person <two
1-29 persons> appointed by the board of trustees of the Sweetwater
1-30 Independent School District;
1-31 (6) one person <three members> appointed by the
1-32 Mitchell County Commissioners Court; <and>
1-33 (7) one person <two members> appointed by the Fisher
1-34 County Commissioners Court;
1-35 (8) the county attorney of Fisher, Mitchell, or Nolan
1-36 County selected by majority vote of the county judges of those
1-37 counties; and
1-38 (9) one person selected by majority vote of the county
1-39 judges of Fisher, Mitchell, and Nolan counties, subject to
1-40 confirmation by a vote of the commissioners courts of each of those
1-41 counties.
1-42 (b) The chairman of the board is the county judge appointed
1-43 under Subsection (a)(1) <by majority vote shall annually elect one
1-44 of its members as chairman>. The chairman presides at meetings
1-45 scheduled by the board.
1-46 (c) The appointed members serve without compensation. Each
1-47 member serves a two-year term.
1-48 (f) The board member appointed by the Sweetwater City
1-49 Commission under Subsection (a)(4) may be appointed only if the
1-50 City of Sweetwater agrees to provide funds for the salaries of the
1-51 personnel assigned to Nolan County and other expenses the board
1-52 chairman certifies as necessary to provide adequate juvenile
1-53 services to Nolan County as provided by Section 152.1831(d).
1-54 (g) The board member appointed by the Sweetwater Independent
1-55 School District under Subsection (a)(5) may be appointed only if
1-56 that school district agrees to provide funds for the salaries of
1-57 the personnel assigned to Nolan County and other expenses the board
1-58 chairman certifies as necessary to provide adequate juvenile
1-59 services to Nolan County as provided by Section 152.1831(d).
1-60 SECTION 2. This Act takes effect September 1, 1995. The
1-61 terms of the members of the Juvenile Board of Mitchell County who
1-62 are serving immediately before the effective date of this Act
1-63 expire on that date. As soon as possible after the effective date
1-64 of this Act, members of the Juvenile Board of Mitchell County shall
1-65 be appointed in accordance with Section 152.1741, Human Resources
1-66 Code, as amended by this Act.
1-67 SECTION 3. The importance of this legislation and the
1-68 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended.
