    1-1                                AN ACT
    1-2  relating to the prohibition of the sale or transfer of certain
    1-3  plumbing fixtures.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 14, The Plumbing License Law (Article
    1-6  6243-101, Vernon's Texas Civil Statutes), is amended by adding
    1-7  Subsection (f) to read as follows:
    1-8        (f)  A person, corporation, or other entity may not sell,
    1-9  donate, or transfer a water closet plumbing fixture or other
   1-10  equipment that uses water that does not comply with a
   1-11  state-approved plumbing code and that may permit the backflow of
   1-12  nonpotable substances into the potable water supply.  The board
   1-13  shall adopt rules under this subsection that include a list
   1-14  describing the types of plumbing fixtures to which this subsection
   1-15  applies.
   1-16        SECTION 2.  (a)  This Act takes effect September 1, 1995.
   1-17        (b)  The change in law made by Section 1 of this Act applies
   1-18  only to a plumbing fixture sold, donated, or transferred on or
   1-19  after January 1, 1996.
   1-20        (c)  The Texas State Board of Plumbing Examiners shall adopt
   1-21  rules under this Act not later than January 1, 1996.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
