                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the prohibition of the sale or transfer of certain
    1-3  plumbing fixtures.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 14, The Plumbing License Law (Article
    1-6  6243-101, Vernon's Texas Civil Statutes), is amended by adding
    1-7  Subsection (f) to read as follows:
    1-8        (f)  A person or other entity may not sell, donate, or
    1-9  transfer a water closet plumbing fixture that may permit siphonage
   1-10  or backflow of the contents of a toilet bowl back into the flush
   1-11  tank.  The board shall adopt rules under this subsection that
   1-12  include a list of the types of plumbing fixtures to which this
   1-13  subsection applies.
   1-14        SECTION 2.  (a)  This Act takes effect September 1, 1995.
   1-15        (b)  The change in law made by Section 1 of this Act applies
   1-16  only to a plumbing fixture sold, donated, or transferred on or
   1-17  after January 1, 1996.
   1-18        (c)  The Texas State Board of Plumbing Examiners shall adopt
   1-19  rules under this Act not later than January 1, 1996.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
