                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to parental access to a child's mental health record.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Chapter 611.0045, Subsection (b), Health and
    1-5  Safety Code, is amended to read as follows:
    1-6        (b)  Subject to Subsection (f), the <The> profesional may deny
    1-7  access to any portion of a record if the profesional determines
    1-8  that release of that portion would be harmful to the patient's
    1-9  physical, mental, or emotional health.
   1-10        SECTION 2.  This Act takes effect September 1, 1995.
   1-11        SECTION 3.  The importance of this legislation and the
   1-12  crowded condition of the calendars in both houses create an
   1-13  emergency and an imperative public necessity that the
   1-14  constitutional rule requiring bills to be read on three several
   1-15  days in each house by suspended, and this rule is hereby suspended.
