                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the composition and powers of the Legislative Health
    1-3  and Human Services Board.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 330.001(b), Government Code, is amended
    1-6  to read as follows:
    1-7        (b)  The board is composed of:
    1-8              (1)  the lieutenant governor, or a senator appointed by
    1-9  the lieutenant governor as the lieutenant governor's
   1-10  representative;
   1-11              (2)  the speaker of the house of representatives, or a
   1-12  house member appointed by the speaker as the speaker's
   1-13  representative;
   1-14              (3)  the chair of the Senate Health and Human Services
   1-15  Committee, or a member of the committee appointed by the  chair of
   1-16  that committee;
   1-17              (4)  the chair of the House Public Health <Senate
   1-18  Finance> Committee, or a member of the committee appointed by the
   1-19  chair of that committee;
   1-20              (5)  the chair of the House Human Services Committee,
   1-21  or a member of the committee appointed by the chair of that
   1-22  committee;
   1-23              (6)  two <four> state representatives appointed by the
   1-24  speaker of the house; and
    2-1              (7) <(6)>  two senators appointed by the lieutenant
    2-2  governor.
    2-3        SECTION 2.  Section 330.002, Government Code, is amended to
    2-4  read as follows:
    2-5        Sec. 330.002.  CHAIR.  The lieutenant governor and speaker of
    2-6  the house shall alternately appoint members to serve <alternate
    2-7  serving> as chair and vice-chair of the board.  Each term as chair
    2-8  is for two years concurrent with the fiscal biennium.
    2-9        SECTION 3.  Section 330.004, Government Code, is amended to
   2-10  read as follows:
   2-11        Sec. 330.004.  MEETINGS.  The board shall meet at least
   2-12  quarterly and at other times at the call of the chair or at the
   2-13  call of a majority of the members of the board or a majority of the
   2-14  board members of either house.  If possible, the board shall meet
   2-15  not earlier than the seventh day before the date on which a
   2-16  Legislative Budget Board meeting is scheduled.
   2-17        SECTION 4.  Section 330.005, Government Code, is amended by
   2-18  amending Subsections (a) and (c) and adding Subsection (g) to read
   2-19  as follows:
   2-20        (a)  The board shall oversee and review the implementation of
   2-21  legislative health and human services policy<, including fiscal
   2-22  policy,> by state agencies that have the statutory duty to
   2-23  implement that policy.  The board's oversight and review functions
   2-24  include fiscal policy such as line-item transfers, Medicaid
   2-25  waivers, structural changes in the Medicaid delivery system,
   2-26  recommendations relating to fraud in the welfare system, and
   2-27  cross-agency programs and projects among the health and human
    3-1  services agencies, including integrated delivery systems and the
    3-2  coordination of delivery of services to children and families under
    3-3  Chapter 72, Human Resources Code.  The board may require
    3-4  information and reports from state agencies as necessary to carry
    3-5  out its duties.
    3-6        (c)  The board shall make regular reports <recommendations>
    3-7  to the legislature and the Legislative Budget Board concerning
    3-8  needed changes in legislative health and human services policy.
    3-9        (g)  The board shall oversee and review local efforts in the
   3-10  health and human services fields, including local models and local
   3-11  matching funds, the flexibility of the use of available funds among
   3-12  the local health and human services agencies, and the blending of
   3-13  funds among those agencies to foster innovation and improve
   3-14  accessibility to federal matching funds.
   3-15        SECTION 5.  The importance of this legislation and the
   3-16  crowded condition of the calendars in both houses create an
   3-17  emergency and an imperative public necessity that the
   3-18  constitutional rule requiring bills to be read on three several
   3-19  days in each house be suspended, and this rule is hereby suspended,
   3-20  and that this Act take effect and be in force from and after its
   3-21  passage, and it is so enacted.
