1-1 AN ACT
1-2 relating to changing the name of the El Paso County Lower Valley
1-3 Water District Authority to the Lower Valley Water District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 1, Chapter 780, Acts of the 69th
1-6 Legislature, Regular Session, 1985, is amended to read as follows:
1-7 Sec. 1. By virtue of Article XVI, Section 59, of the Texas
1-8 Constitution a conservation and reclamation district is hereby
1-9 created to be known as the <El Paso County> Lower Valley Water
1-10 District <Authority> (hereinafter called "authority"), which shall
1-11 be a governmental agency and a body politic and corporate.
1-12 SECTION 2. Section 2A, Chapter 780, Acts of the 69th
1-13 Legislature, Regular Session, 1985, is amended to read as follows:
1-14 Sec. 2A. If the Homestead Municipal Utility District No. 1
1-15 or Homestead Municipal Utility District No. 2 is established by Act
1-16 of the 69th Legislature, Regular Session, 1985, and receives the
1-17 required subsequent approval of the qualified voters at a
1-18 confirmation election, the territory of the approved district is
1-19 excluded from the boundaries of the <El Paso County> Lower Valley
1-20 Water District <Authority>.
1-21 SECTION 3. Section 3(g), Chapter 780, Acts of the 69th
1-22 Legislature, Regular Session, 1985, is amended to read as follows:
1-23 (g) If the board determines that in order to ensure fair
1-24 representation it would be in the best interest of the people of
2-1 the <El Paso County> Lower Valley Water District <Authority> to
2-2 change the method by which directors are elected, then the board
2-3 may adopt any plan of redistricting, including a plan based on
2-4 equal geographical areas, that is in conformity with the laws and
2-5 constitutions of both Texas and the United States.
2-6 SECTION 4. The name change made by this Act does not affect
2-7 the obligations or powers of the entity formerly known as the El
2-8 Paso County Lower Valley Water District Authority.
2-9 SECTION 5. The importance of this legislation and the
2-10 crowded condition of the calendars in both houses create an
2-11 emergency and an imperative public necessity that the
2-12 constitutional rule requiring bills to be read on three several
2-13 days in each house be suspended, and this rule is hereby suspended,
2-14 and that this Act take effect and be in force from and after its
2-15 passage, and it is so enacted.
