1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to changing the name of the El Paso County Lower Valley
1-9 Water District Authority to the Lower Valley Water District.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 1, Chapter 780, Acts of the 69th
1-12 Legislature, Regular Session, 1985, is amended to read as follows:
1-13 Sec. 1. By virtue of Article XVI, Section 59, of the Texas
1-14 Constitution a conservation and reclamation district is hereby
1-15 created to be known as the <El Paso County> Lower Valley Water
1-16 District <Authority> (hereinafter called "authority"), which shall
1-17 be a governmental agency and a body politic and corporate.
1-18 SECTION 2. Section 2A, Chapter 780, Acts of the 69th
1-19 Legislature, Regular Session, 1985, is amended to read as follows:
1-20 Sec. 2A. If the Homestead Municipal Utility District No. 1
1-21 or Homestead Municipal Utility District No. 2 is established by Act
1-22 of the 69th Legislature, Regular Session, 1985, and receives the
1-23 required subsequent approval of the qualified voters at a
1-24 confirmation election, the territory of the approved district is
1-25 excluded from the boundaries of the <El Paso County> Lower Valley
1-26 Water District <Authority>.
1-27 SECTION 3. Section 3(g), Chapter 780, Acts of the 69th
1-28 Legislature, Regular Session, 1985, is amended to read as follows:
1-29 (g) If the board determines that in order to ensure fair
1-30 representation it would be in the best interest of the people of
1-31 the <El Paso County> Lower Valley Water District <Authority> to
1-32 change the method by which directors are elected, then the board
1-33 may adopt any plan of redistricting, including a plan based on
1-34 equal geographical areas, that is in conformity with the laws and
1-35 constitutions of both Texas and the United States.
1-36 SECTION 4. The name change made by this Act does not affect
1-37 the obligations or powers of the entity formerly known as the El
1-38 Paso County Lower Valley Water District Authority.
1-39 SECTION 5. The importance of this legislation and the
1-40 crowded condition of the calendars in both houses create an
1-41 emergency and an imperative public necessity that the
1-42 constitutional rule requiring bills to be read on three several
1-43 days in each house be suspended, and this rule is hereby suspended,
1-44 and that this Act take effect and be in force from and after its
1-45 passage, and it is so enacted.
