A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the requirement that the holder of a discharged lien on
1-3 a motor vehicle execute the discharge of the lien.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 47, Certificate of Title Act (Article
1-6 6687-1, Vernon's Texas Civil Statutes), is amended to read as
1-7 follows:
1-8 Sec. 47. (a) When a lien is discharged, the holder of the
1-9 lien <thereof> shall:
1-10 (1) <, on demand of the owner,> execute the discharge
1-11 of the lien on the <upon such> form <as may be> prescribed by the
1-12 Department; <,> and
1-13 (2) on behalf <upon presentation> of <such evidence,>
1-14 the owner of the vehicle, apply for a new <may present the>
1-15 certificate of title to the designated agent in the county
1-16 <together with application for title> as prescribed in this Act
1-17 <and shall receive from the Department a new title>.
1-18 (b) On receipt of an application for a new certificate of
1-19 title under Subsection (a), after the requirements of this Act are
1-20 met, including the payment of required fees, the Department shall
1-21 issue the owner a new certificate of title.
1-22 SECTION 2. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
