A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to personnel records maintained by certain sheriff's
1-3 departments.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 157.904(a) and (c), Local Government
1-6 Code, are amended to read as follows:
1-7 (a) This section applies only to a sheriff's department in a
1-8 county with a population of 100,000 <2,000,000> or more.
1-9 (c) In a county with a population of 2,000,000 or more, the
1-10 <The> sheriff or the sheriff's designee shall maintain a permanent
1-11 personnel file on each department employee. In any county to which
1-12 this section applies and in which the sheriff or the sheriff's
1-13 designee maintains a <An employee's> permanent personnel file, the
1-14 file must contain any employee record relating to:
1-15 (1) a commendation, congratulation, or honor bestowed
1-16 on the employee by a member of the public or by the department for
1-17 an action, duty, or activity that relates to the employee's
1-18 official duties;
1-19 (2) any misconduct by the employee if the employee
1-20 record is made by the department and if the misconduct resulted in
1-21 disciplinary action by the department; and
1-22 (3) the periodic evaluation of the employee by a
1-23 supervisor.
1-24 SECTION 2. The importance of this legislation and the
2-1 crowded condition of the calendars in both houses create an
2-2 emergency and an imperative public necessity that the
2-3 constitutional rule requiring bills to be read on three several
2-4 days in each house be suspended, and this rule is hereby suspended,
2-5 and that this Act take effect and be in force from and after its
2-6 passage, and it is so enacted.
