A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the lease and sale of certain land by the Texas
1-3 Low-Level Radioactive Waste Disposal Authority.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 402.094, Health and Safety Code, is
1-6 amended by amending Subsection (d) and adding Subsection (e) to
1-7 read as follows:
1-8 (d) The authority may lease or sell land owned by the
1-9 authority that is not part of a licensed disposal site. Land
1-10 leased or sold by the authority under this section may not be used
1-11 <only> for <agricultural, ranching, or grazing> purposes that may
1-12 interfere with proper operation of the disposal site and may not be
1-13 used for a facility that stores, processes, or disposes of waste,
1-14 other than a facility owned and operated by a unit of local
1-15 government.
1-16 (e) The authority shall include in a lease or deed executed
1-17 under Subsection (d) a statement that the land may not be used for
1-18 purposes that may interfere with proper operation of the disposal
1-19 site. The authority shall file a copy of the deed in the deed
1-20 records of the county in which land sold under that subsection is
1-21 located.
1-22 SECTION 2. (a) This Act takes effect September 1, 1995.
1-23 (b) The change in law made by Section 402.094(e), Health and
1-24 Safety Code, as added by this Act, applies only to a lease or deed
2-1 executed or to the deed records of land sold on or after that date.
2-2 SECTION 3. The importance of this legislation and the
2-3 crowded condition of the calendars in both houses create an
2-4 emergency and an imperative public necessity that the
2-5 constitutional rule requiring bills to be read on three several
2-6 days in each house be suspended, and this rule is hereby suspended.
