                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to litter abatement of self-generated litter.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 365.011, Health and Safety Code, is
    1-5  amended by adding Subdivision (9) to read as follows:
    1-6              (9)  "Self-generated litter or self-generated other
    1-7  solid waste" means litter or other solid waste generated by a
    1-8  natural person or that person's agent on land owned by that person.
    1-9        SECTION 2.  Subsection (j), Section 365.0012, Health and
   1-10  Safety Code, is amended to read as follows:
   1-11        (j)  This section does not apply to the <disposal of, or>
   1-12  temporary storage for future legal disposal of<,> self-generated
   1-13  litter or self-generated other solid waste by a natural person on
   1-14  land owned by that person or that person's agent.
   1-15        SECTION 3.  SEVERABILITY.  If any section, sentence, clause,
   1-16  or part of this Act shall, for any reason, be held invalid, such
   1-17  invalidity shall not affect the remaining portions of the Act, and
   1-18  it is hereby declared to be the intention of this legislature to
   1-19  have passed each section, sentence, clause, or part irrespective of
   1-20  the fact that any other section, sentence, clause, or part may be
   1-21  declared invalid.
   1-22        SECTION 4.  EFFECTIVE DATE.  This Act takes effect on
   1-23  September 1, 1995.
    2-1        SECTION 5.  EMERGENCY.  The importance of this legislation
    2-2  and the crowded condition of the calendars in both houses create an
    2-3  emergency and an imperative public necessity that the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended.
