                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to altering the business form of the holder of a permit
    1-3  allowing the sale or service of alcoholic beverages for on-premise
    1-4  consumption.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Subchapter A, Chapter 11, Alcoholic Beverage
    1-7  Code, is amended by adding Section 11.12 to read as follows:
    1-8        Sec. 11.12.  CHANGE IN FORM OF OWNERSHIP.  The holder of a
    1-9  permit allowing the sale or service of alcoholic beverages for
   1-10  on-premise consumption may alter the form of business under which a
   1-11  permit is held if the ownership of the new form of business is
   1-12  substantially similar to that of the prior form unless the physical
   1-13  location of the business is within 1,000 feet of the property line
   1-14  of a public school.  For the purposes of this section,
   1-15  "substantially similar" means a 90 percent ownership interest by
   1-16  the same person or persons in both the prior business form and the
   1-17  new business form.  A person changing the form of ownership of a
   1-18  business holding a permit allowing the on-premise sale or service
   1-19  of alcoholic beverages shall pay a fee of $100 for each licensed
   1-20  premise, and the new business form shall succeed to all the
   1-21  privileges of the prior business form in the permit.
   1-22        SECTION 2.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
