By Hilderbran H.B. No. 1719 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to altering the business form of the holder of a permit 1-3 allowing the sale or service of alcoholic beverages for on-premise 1-4 consumption. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Chapter 11, Alcoholic Beverage Code is amended by 1-7 adding a new Section 11.12 to read as follows: 1-8 Section 11.12. CHANGE IN FORM OF OWNERSHIP. The holder of a 1-9 permit allowing the sale or service of alcoholic beverages for 1-10 on-premise consumption may alter the form of business under which a 1-11 permit is held if the ownership of the new form of business is 1-12 substantially similar to that of the prior form. For the purposes 1-13 of this section, substantially similar means a 90 percent ownership 1-14 interest by the same person or persons in both the prior business 1-15 form and the new business form. A person changing the form of 1-16 ownership of a business holding a permit allowing the on-premise 1-17 sale or service of alcoholic beverages shall pay a fee of $100 for 1-18 each licensed premise and the new business form shall succeed to 1-19 all the privileges of the prior business form in the permit. 1-20 SECTION 2. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 2-1 days in each house be suspended, and this rule is hereby suspended.
