1-7 COMMITTEE AMENDMENT NO. 1 By: Ellis
1-8 Amend H.B 1770 by creating a new Section 3 to read as follows and
1-9 renumbering all following sections appropriately:
1-10 SECTION 3. Section 157.021, Local Governmental Code, is
1-11 amended to read as follows:
1-12 Sec. 157.021. HOURS OF WORK OF COUNTY EMPLOYEES <IN COUNTIES
1-13 OF 355,000 OR MORE>
1-14 (a) In a county with a population of 355,000 or more, the
1-15 commissioners court may adopt and enforce uniform rules on the
1-16 hours of work of department heads, assistants, deputies, and other
1-17 employees whose compensation is set or approved by the court.
1-18 (b) The commissioners court of any county may adopt and
1-19 enforce uniform rules on overtime and compensatory time for
1-20 department heads, assistants, deputies and other employees whose
1-21 compensation is set or approved by the commissioners court. The
1-22 rules may:
1-23 (1) prohibit unbudgeted overtime, except when the
1-24 commissioners court or an elected county or district officer
1-25 declares an emergency; and
1-26 (2) require that emergency overtime be reported to the
1-27 county auditor and the commissioners court.
1-28 A BILL TO BE ENTITLED
1-29 AN ACT
1-30 relating to the ability of voters in certain counties to petition a
1-31 commissioners court to increase the salary of members of the county
1-32 sheriff's department.
1-33 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-34 SECTION 1. Section 152.072(a), Local Government Code, is
1-35 amended to read as follows:
1-36 (a) The qualified voters of a county with a population of
1-37 more than 30,000 <75,000> may petition the commissioners court of
1-38 the county to increase the minimum salary of each member of the
1-39 sheriff's department.
1-40 SECTION 2. Section 152.073(a), Local Government Code, is
1-41 amended to read as follows:
1-42 (a) A person who is a county official <in a county with a
1-43 population of more than 75,000> and who is in charge of the
1-44 sheriff's department or is responsible for setting the compensation
1-45 provided by Sections 152.071 and 152.072 commits an offense if the
1-46 person violates Section 152.071 or 152.072.
1-47 SECTION 3. The importance of this legislation and the
1-48 crowded condition of the calendars in both houses create an
1-49 emergency and an imperative public necessity that the
1-50 constitutional rule requiring bills to be read on three several
1-51 days in each house be suspended, and this rule is hereby suspended,
1-52 and that this Act take effect and be in force from and after its
1-53 passage, and it is so enacted.
