                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the bond required of certain guardians.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 702(b), Texas Probate Code, is amended to
    1-5  read as follows:
    1-6        (b)  A bond is not required to be given by a guardian that
    1-7  is:
    1-8              (1)  a corporate fiduciary, as defined by Section
    1-9  601(5) of this code; or
   1-10              (2)  a guardianship program operated by a county with a
   1-11  population of more than 2.5 million, according to the most recent
   1-12  federal decennial census.
   1-13        SECTION 2.  This Act takes effect September 1, 1995.  The
   1-14  changes in law made by this Act apply only to a person appointed by
   1-15  a court to serve as guardian of the person of a ward on or after
   1-16  the effective date of this Act.  A person who is appointed by a
   1-17  court to serve as guardian of the person of a ward before the
   1-18  effective date of this Act is governed by the law in effect on the
   1-19  date the person was appointed by the court, and the former law is
   1-20  continued in effect for that purpose.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
