                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating  to the possession or consumption of an alcoholic beverage
    1-3  on the premises of a sexually oriented business that does not have
    1-4  an alcoholic beverage permit or license; providing a criminal
    1-5  penalty.
    1-6        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-7        SECTION 1.  Subchapter D, Chapter 109, Alcoholic Beverage
    1-8  Code, is amended by adding Section 109.61 to read as follows:
    1-9        Sec. 109.61.  CONSUMPTION OR POSSESSION OF ALCOHOLIC BEVERAGE
   1-10  ON CERTAIN PREMISES PROHIBITED.  (a)  A person may not possess or
   1-11  consume an alcoholic beverage on the premises of a building or a
   1-12  business that:
   1-13              (1)  is not licensed or permitted under this code; and
   1-14              (2)  is used in the operation of a sexually oriented
   1-15  business.
   1-16        (b)  A person commits an offense if the person violates
   1-17  Subsection (a).  An offense under this section is a Class C
   1-18  misdemeanor.
   1-19        (c)  In this section, "sexually oriented business" has the
   1-20  meaning assigned by Section 243.002, Local Government Code.
   1-21        SECTION 2.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
