                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the prohibition of certain conditions as a requirement
    1-3  for employment by a political subdivision.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 180, Local Government Code, is amended by
    1-6  adding Section 180.004 to read as follows:
    1-7        Sec. 180.004.  PROHIBITION OF CERTAIN CONDITIONS AS
    1-8  REQUIREMENT FOR EMPLOYMENT BY MUNICIPALITIES, COUNTIES, OR OTHER
    1-9  POLITICAL SUBDIVISIONS.  (a)  A municipality, county, or other
   1-10  political subdivision of this state may not require as a condition
   1-11  of employment that a person:
   1-12              (1)  waive the person's constitutional rights; or
   1-13              (2)  release the municipality, county, or political
   1-14  subdivision from liability for ordering the person to take a
   1-15  polygraph examination.
   1-16        (b)  An ordinance, a rule, a resolution, an order, or another
   1-17  statement of policy of a municipality, county, or other political
   1-18  subdivision of this state that violates Subsection (a) is void.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
   1-24  and that this Act take effect and be in force from and after its
    2-1  passage, and it is so enacted.
