                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to an exemption from certain license renewal requirements
    1-3  for certain persons licensed by the Texas Structural Pest Control
    1-4  Board.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  The Texas Structural Pest Control Act (Article
    1-7  135b-6, Vernon's Texas Civil Statutes) is amended by adding Section
    1-8  6A to read as follows:
    1-9        Sec. 6A.  EXEMPTION FROM CERTAIN RENEWAL REQUIREMENTS.  (a)
   1-10  This section applies to a person who:
   1-11              (1)  holds a technician license, certified commercial
   1-12  applicator license, or structural pest control business license
   1-13  issued under this Act; and
   1-14              (2)  has been engaged in the business of structural
   1-15  pest control for at least 10 years on September 1, 1995.
   1-16        (b)  A license holder subject to this section may renew the
   1-17  holder's license by notifying the board in writing before the
   1-18  expiration date of the license of the holder's intent to continue
   1-19  to engage in the business of structural pest control.  A holder
   1-20  subject to this section is not required to pay a renewal fee, pass
   1-21  a renewal examination, or participate in any mandatory continuing
   1-22  education program adopted under this Act or by board rule to renew
   1-23  the license.
   1-24        (c)  This section does not affect the authority of the board
    2-1  to require a license holder subject to this section to participate
    2-2  in a training program under Section 7(e) of this Act.
    2-3        SECTION 2.  This Act takes effect September 1, 1995, and
    2-4  applies only to a license issued by the Texas Structural Pest
    2-5  Control Board that is renewed on or after that date.  A license
    2-6  renewed before that date is governed by the law in effect on the
    2-7  expiration date of the license subject to renewal, and the former
    2-8  law is continued in effect for that purpose.
    2-9        SECTION 3.  The importance of this legislation and the
   2-10  crowded condition of the calendars in both houses create an
   2-11  emergency and an imperative public necessity that the
   2-12  constitutional rule requiring bills to be read on three several
   2-13  days in each house be suspended, and this rule is hereby suspended.
