                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to uniform rules on the hours of work by county employees.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 157.021, Local Government Code, is
    1-5  amended to read as follows:
    1-6        Sec. 157.021.  HOURS OF WORK OF COUNTY EMPLOYEES <IN COUNTIES
    1-7  OF 355,000 OR MORE>.  (a)  In a county with a population of 355,000
    1-8  or more, the commissioners court may adopt and enforce uniform
    1-9  rules on the hours of work of department heads, assistants,
   1-10  deputies, and other employees whose compensation is set or approved
   1-11  by the court.
   1-12        (b)  The commissioners court of any county may adopt and
   1-13  enforce uniform rules on overtime and compensatory time for
   1-14  department heads, assistants, deputies, and other employees whose
   1-15  compensation is set or approved by the commissioners court. The
   1-16  rules may:
   1-17              (1)  prohibit unbudgeted overtime, except when the
   1-18  commissioners court or an elected county or district officer
   1-19  declares an emergency; and
   1-20              (2)  require that emergency overtime be reported to the
   1-21  county auditor and the commissioners court.
   1-22        SECTION 2.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force from and after its
    2-4  passage, and it is so enacted.
