A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to day-care centers operated by the Texas Department of
1-3 Human Services.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 44.031, Human Resources Code, is amended
1-6 to read as follows:
1-7 Sec. 44.031. Establishment. <(a)> The Texas Department of
1-8 Human Services shall <department may> establish day-care centers
1-9 for all children who qualify for services under Section 44.032 <of
1-10 this code>. Where in the opinion of the department it appears
1-11 feasible for the furtherance of the objectives of this legislation,
1-12 the department may establish cooperative agreements with other
1-13 state agencies.
1-14 <(b) The department is not required to establish a day-care
1-15 center or to provide services under this subchapter unless funds
1-16 are appropriated for that purpose.>
1-17 SECTION 2. Section 44.034(a), Human Resources Code, is
1-18 amended to read as follows:
1-19 (a) The Texas Department of Human Services <If the
1-20 department establishes day-care centers under this subchapter, the
1-21 department> shall prescribe standards of operation and performance
1-22 for day-care <the> centers established under this subchapter that
1-23 will ensure proper nutrition, social adjustment, health services,
1-24 and appropriate growth and development for children admitted.
2-1 SECTION 3. Section 44.036, Human Resources Code, is amended
2-2 to read as follows:
2-3 Sec. 44.036. Annual Evaluation of Day-Care Centers. The
2-4 Texas Department of Human Services <If the department establishes
2-5 day-care centers or provides services under this subchapter, the
2-6 department> shall evaluate the performance of day-care <the>
2-7 centers established under this subchapter each state fiscal year.
2-8 This evaluation shall be sent to the governor and to the
2-9 Legislative Budget Board not later than the 100th day after the
2-10 last day of the state fiscal year covered by the evaluation.
2-11 SECTION 4. This Act takes effect September 1, 1995.
2-12 SECTION 5. The importance of this legislation and the
2-13 crowded condition of the calendars in both houses create an
2-14 emergency and an imperative public necessity that the
2-15 constitutional rule requiring bills to be read on three several
2-16 days in each house be suspended, and this rule is hereby suspended.
