A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the juvenile board of Bexar County.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 152.0211, Human Resources Code, is
1-5 amended to read as follows:
1-6 Sec. 152.0211. Bexar County. (a) The juvenile board of
1-7 Bexar County is composed of:
1-8 (1) the county judge;
1-9 (2) one county commissioner appointed by the
1-10 commissioners court;
1-11 (3) the judge of each court designated as a juvenile
1-12 court;
1-13 (4) the local administrative district judge;
1-14 (5) one judge of a district court <and the district
1-15 judges> in Bexar County that gives preference to criminal matters,
1-16 appointed by the judges of those courts;
1-17 (6) one judge of a district court in Bexar County that
1-18 gives preference to civil matters, appointed by the judges of those
1-19 courts; and
1-20 (7) the chairman of the juvenile board advisory
1-21 council created under Section 152.0010.
1-22 (b) The appointed members serve one-year terms
1-23 <commissioners court shall pay the county judge additional annual
1-24 compensation of $4,500. The county commissioners court shall pay
2-1 the district judges on the board an additional annual salary of
2-2 $1,500. The additional compensation paid to the county and
2-3 district judges shall be paid in equal monthly installments from
2-4 the general fund of the county>.
2-5 (c) The juvenile board shall hold an annual meeting in
2-6 January and at this meeting shall elect a chairman from among the
2-7 members. The board shall hold other meetings as determined by the
2-8 board at its January meeting and may meet at the call of the
2-9 chairman or at the request to the chairman of at least two members
2-10 <meetings at least once every three months in accordance with board
2-11 rules>.
2-12 <(d)> The board shall keep accurate and complete minutes of
2-13 its meetings. The minutes are open to public inspection <records
2-14 as required by law and board rules>.
2-15 (d) All county facilities and programs for children, other
2-16 than the facilities and programs operated by the Bexar County
2-17 Hospital District or the local mental health or mental retardation
2-18 authority serving Bexar County, are under the board's jurisdiction.
2-19 (e) The juvenile board shall set policies for the juvenile
2-20 probation department and other departments, facilities, and
2-21 programs under the board's jurisdiction <A juvenile probation
2-22 officer shall take the oath of office when appointed and the oath
2-23 and the fact of the appointment shall be filed with the county
2-24 clerk>.
2-25 (f) The juvenile board shall make an annual report to the
2-26 commissioners court that relates to the operation and efficiency of
2-27 the juvenile probation department, the county and other
3-1 institutions for the care of neglected, dependent, and delinquent
3-2 children, and the other facilities and programs under the board's
3-3 jurisdiction and to the general adequacy of the juvenile services
3-4 provided by the county. The board shall include in the report any
3-5 recommendations for improvements the board considers necessary <The
3-6 commissioners court shall provide the juvenile probation officers
3-7 with:>
3-8 <(1) automobiles and their maintenance and operation
3-9 expenses for use in official duties; or>
3-10 <(2) an automobile allowance for the use of a personal
3-11 automobile on official business in the amount determined to be
3-12 necessary by the commissioners court>.
3-13 (g) The juvenile board shall submit a budget of expenditures
3-14 of county funds to the commissioners court. The juvenile board may
3-15 not make an expenditure of county funds unless the expenditure is
3-16 approved by the commissioners court.
3-17 (h) The juvenile board may investigate the operations of the
3-18 juvenile probation department, the county institutions for the care
3-19 of neglected, dependent, or delinquent children, or any other
3-20 facility or program under the board's jurisdiction at the request
3-21 of the judges of the district courts in Bexar County. The board
3-22 shall make a written report of the investigation to the
3-23 commissioners court <The commissioners court shall provide the
3-24 necessary funds to pay the salaries and expenses of the juvenile
3-25 probation personnel>.
3-26 (i) The juvenile board may make any special studies or
3-27 investigations it considers necessary to improve the operation of
4-1 the juvenile probation department and the county institutions under
4-2 its jurisdiction and shall provide a written report of the findings
4-3 to the commissioners court.
4-4 (j) The juvenile board, with the approval of the
4-5 commissioners court, may appoint a person to serve as chief
4-6 juvenile probation officer. The board, with the approval of the
4-7 commissioners court, may set the salary of the chief juvenile
4-8 probation officer. The chief juvenile probation officer serves at
4-9 the pleasure of the board.
4-10 (k) The board may apply for, accept, hold in trust, spend,
4-11 and use a gift, grant, or donation of land, money, or other
4-12 personal property from a governmental, corporate, personal, or
4-13 other source to benefit the county facilities and programs under
4-14 the board's jurisdiction.
4-15 (l) <(h)> Sections 152.0002, 152.0003, 152.0004, 152.0005,
4-16 152.0006, 152.0007, and 152.0008 <152.0008(a)> do not apply to the
4-17 juvenile board of Bexar County.
4-18 SECTION 2. This Act takes effect September 1, 1995.
4-19 SECTION 3. The importance of this legislation and the
4-20 crowded condition of the calendars in both houses create an
4-21 emergency and an imperative public necessity that the
4-22 constitutional rule requiring bills to be read on three several
4-23 days in each house be suspended, and this rule is hereby suspended.
