                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to creating the Kenedy County Public Lands and Water
    1-3  Sanctuary; providing a penalty.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 82, Parks and Wildlife Code, is amended
    1-6  by adding Subchapter M to read as follows:
    1-7     SUBCHAPTER M.  KENEDY COUNTY PUBLIC LANDS AND WATER SANCTUARY
    1-8        Sec. 82.741.  CREATION.  All of the state-owned land and
    1-9  public water in Kenedy County, including the water, creekbed, and
   1-10  banks of Los Olmos Creek, is a game sanctuary.
   1-11        Sec. 82.742.  PROHIBITED ACTS.  (a)  Except as permitted
   1-12  under Subsection (b) or (c), no person may possess, hunt, or kill
   1-13  an animal or bird in the game sanctuary created by Section 82.741.
   1-14        (b)  Subsection (a) does not apply:
   1-15              (1)  during the time that the person is in actual
   1-16  discharge of official duties, to:
   1-17                    (A)  a peace officer of this state;
   1-18                    (B)  a law enforcement officer of the United
   1-19  States; or
   1-20                    (C)  a department employee or a federal wildlife
   1-21  management employee; or
   1-22              (2)  to a person who holds a permit issued under
   1-23  Section 43.022 and is acting under the terms of the permit.
   1-24        (c)  Subsection (a) does not apply to a person who hunts
    2-1  waterfowl during the waterfowl season.
    2-2        Sec. 82.743.  PENALTY.  A person who violates Section 82.742
    2-3  commits an offense that is a Class C Parks and Wildlife Code
    2-4  misdemeanor.
    2-5        SECTION 2.  The importance of this legislation and the
    2-6  crowded condition of the calendars in both houses create an
    2-7  emergency and an imperative public necessity that the
    2-8  constitutional rule requiring bills to be read on three several
    2-9  days in each house be suspended, and this rule is hereby suspended.

   2-11        Amend H.B. 1927 as follows:
   2-12        (1)  On page 1, line 8, strike Sec. 82.741 and substitute
   2-13  "Sec. 82.741.  CREATION.  All of the land area and public water in
   2-14  state-owned riverbeds in Kenedy County, including the water,
   2-15  creekbed, and banks of Los Olmos Creek, is a game preserve.".

   2-18        Amend H.B. 1927 as follows:
   2-19        (1)  On page 1, line 12, strike "or (c)".
   2-20        (2)  On page 1, line 13, strike "animal" and substitute
   2-21  "exotic animal as defined by Section 62.015, game animal,
   2-22  fur-bearing animal,".
   2-23        (3)  On page 1, strike lines 22-24 and substitute the
   2-24  following:
   2-25              (2)  to a person who:
   2-26                    (A)  holds a permit issued under Section 43.022
   2-27  and is acting under the terms of the permit;
    3-1                    (B)  is conducting an activity authorized under a
    3-2  lease, easement, or permit issued by the General Land Office or the
    3-3  School Land Board other than hunting or the possession of an animal
    3-4  or bird protected under Subsection (a);
    3-5                    (C)  hunts waterfowl during waterfowl season; or
    3-6                    (D)  is transporting on public roads lawfully
    3-7  taken or possessed animals or birds.
