                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to creating the Kenedy County Public Lands and Water
    1-3  Sanctuary; providing a penalty.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 82, Parks and Wildlife Code, is amended
    1-6  by adding Subchapter M to read as follows:
    1-7     SUBCHAPTER M.  KENEDY COUNTY PUBLIC LANDS AND WATER SANCTUARY
    1-8        Sec. 82.741.  CREATION.  All of the state-owned land and
    1-9  public water in Kenedy County, including the water, creekbed, and
   1-10  banks of Los Olmos Creek, is a game sanctuary.
   1-11        Sec. 82.742.  PROHIBITED ACTS.  (a)  Except as permitted
   1-12  under Subsection (b) or (c), no person may possess, hunt, or kill
   1-13  an animal or bird in the game sanctuary created by Section 82.741.
   1-14        (b)  Subsection (a) does not apply:
   1-15              (1)  during the time that the person is in actual
   1-16  discharge of official duties, to:
   1-17                    (A)  a peace officer of this state;
   1-18                    (B)  a law enforcement officer of the United
   1-19  States; or
   1-20                    (C)  a department employee or a federal wildlife
   1-21  management employee; or
   1-22              (2)  to a person who holds a permit issued under
   1-23  Section 43.022 and is acting under the terms of the permit.
   1-24        (c)  Subsection (a) does not apply to a person who hunts
    2-1  waterfowl during the waterfowl season.
    2-2        Sec. 82.743.  PENALTY.  A person who violates Section 82.742
    2-3  commits an offense that is a Class C Parks and Wildlife Code
    2-4  misdemeanor.
    2-5        SECTION 2.  The importance of this legislation and the
    2-6  crowded condition of the calendars in both houses create an
    2-7  emergency and an imperative public necessity that the
    2-8  constitutional rule requiring bills to be read on three several
    2-9  days in each house be suspended, and this rule is hereby suspended.
