    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to the representative of industrial energy consumers on
    1-9  the Texas Energy Coordination Council.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  Section 3.01, Article 4413(47f), Vernon's Texas
   1-12  Civil Statutes, is amended to read as follows:
   1-13        Sec. 3.01.  Composition.  (a)  The Texas Energy Coordination
   1-14  Council is composed of the following ex officio members:
   1-15              (1)  a representative from Texas Tech University to be
   1-16  designated by the president of the university;
   1-17              (2)  the director of the Energy System Laboratory of
   1-18  Texas A&M University;
   1-19              (3)  the director of the Center for Energy Studies at
   1-20  The University of Texas at Austin;
   1-21              (4)  <a representative of industrial energy consumers;>
   1-22              <(5)>  the director of the Energy Laboratory of the
   1-23  University of Houston; and
   1-24              (5) <(6)>  the director of the Alternative Energy
   1-25  Institute of West Texas State University.
   1-26        (b)  The governor shall appoint the following members to
   1-27  serve on the council:
   1-28              (1)  a representative of the natural gas industry;
   1-29              (2)  a representative of the oil industry;
   1-30              (3)  a representative of the alternative fuels
   1-31  industry;
   1-32              (4)  a representative of the Texas Sustainable Energy
   1-33  Development Council or renewable energy industry;
   1-34              (5)  a representative of the electric utility industry;
   1-35              (6)  a representative of industrial energy consumers;
   1-36  and
   1-37              (7) <(6)>  a representative of an energy consumer
   1-38  organization or environmental organization.
   1-39        (c)  If a postsecondary educational institution eliminates
   1-40  the entity whose director serves on the council, the institution
   1-41  shall name a representative to serve on the council.  The
   1-42  representative must be an individual at the institution with
   1-43  responsibilities related to the mission of the council and must
   1-44  hold a position of a level similar to the level of the position of
   1-45  director of the eliminated entity.
   1-46        SECTION 2.  The importance of this legislation and the
   1-47  crowded condition of the calendars in both houses create an
   1-48  emergency and an imperative public necessity that the
   1-49  constitutional rule requiring bills to be read on three several
   1-50  days in each house be suspended, and this rule is hereby suspended,
   1-51  and that this Act take effect and be in force from and after its
   1-52  passage, and it is so enacted.
