No. 1976 74R5184 MJW-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the conveyance of certain state-owned real property in 1-3 Harris County to the city of Bellaire. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. AUTHORIZATION FOR CONVEYANCE. (a) The Texas 1-6 Department of Transportation may convey, on behalf of the state, 1-7 all of the interest of the state in the real property described by 1-8 Section 2 of this Act and all improvements on the property to the 1-9 city of Bellaire. 1-10 (b) This conveyance is in recognition of the development of 1-11 the property described by Section 2 of this Act by the city of 1-12 Bellaire as a public park and the city's continued maintenance of 1-13 the property as a public park. 1-14 (c) The legislature intends that the city of Bellaire 1-15 continue to use and maintain the property described by Section 2 of 1-16 this Act as a public park. 1-17 (d) Section 31.158, Natural Resources Code, does not apply 1-18 to the conveyance authorized by this section. 1-19 SECTION 2. PROPERTY DESCRIPTION. The real property 1-20 authorized to be conveyed under Section 1 of this Act is a 0.4890 1-21 acre (21,299 square feet) tract of land being a portion of Lots 29 1-22 through 36 in Post Oak Court Subdivision recorded in Volume 36, 1-23 Page 49 of the Harris County Map Records and described in deeds 1-24 recorded under Volume 3792, Page 440; Volume 3671, Page 13; Volume 2-1 3600, Page 693; Volume 3685, Page 425; Volume 3675, Page 498; 2-2 Volume 3956, Page 152; Volume 3733, Page 615 and Volume 3725, Page 2-3 635, respectively, of the Harris County Deed Records; being more 2-4 particularly described in metes and bounds as follows: 2-5 BEGINNING at the southwest corner of said Lot 36 and marking 2-6 the intersection of the east right-of-way line of East Jacquet 2-7 Drive (60 feet wide) with the north right-of-way line of Elm Street 2-8 (60 feet wide); 2-9 THENCE, North 02 25' 00" West, 455.00 feet along said east 2-10 right-of-way line of East Jacquet Drive to a 5/8-inch iron rod 2-11 found marking the northwest corner of aforementioned Lot 30 and 2-12 being the beginning of a tangent curve to the left; 2-13 THENCE, 42.36 feet along the arc of said curve, and east 2-14 right-of-way line of East Jacquet Drive to the left having a radius 2-15 of 55.00 feet, a central angle of 44 07' 41", a long chord bearing 2-16 North 24 28' 51" West, 41.32 feet to a 5/8-inch iron rod found 2-17 marking the most westerly corner of aforementioned Lot 29 for 2-18 corner; 2-19 THENCE, North 43 26' 19" East, 77.16 feet leaving said east 2-20 right-of-way line to a point for corner; 2-21 THENCE, South 02 24' 08" East, 547.02 feet along a fence 2-22 line to a point marking the intersection of said line with the 2-23 aforementioned north right-of-way line of Elm Street for corner; 2-24 THENCE, South 87 35' 00" West, 39.72 feet along said north 2-25 right-of-way line of Elm Street to the POINT OF BEGINNING, 2-26 CONTAINING 0.4890 acre of land in Harris County, Texas. 2-27 SECTION 3. EMERGENCY. The importance of this legislation 3-1 and the crowded condition of the calendars in both houses create an 3-2 emergency and an imperative public necessity that the 3-3 constitutional rule requiring bills to be read on three several 3-4 days in each house be suspended, and this rule is hereby suspended, 3-5 and that this Act take effect and be in force from and after its 3-6 passage, and it is so enacted.
