A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the compensation of certain school district employees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 16.056, Education Code, is amended by
1-5 amending Subsections (a)-(d) and (f) and adding Subsection (i) to
1-6 read as follows:
1-7 (a) School district personnel who are qualified for and
1-8 employed in positions described in Subsection (d) of this section
1-9 shall be paid not less than the monthly base salary, plus
1-10 increments for employment <teaching> experience, set forth in
1-11 Subsection (c) or (i) of this section, or greater amounts provided
1-12 by appropriation.
1-13 (b) Each individual shall advance on the salary schedule
1-14 under Subsection (c) that is applicable based on the classification
1-15 of the individual's employment under Subsection (d) as professional
1-16 or paraprofessional and on the academic degrees the employee has,
1-17 one step per each year of experience until step 20 <10> is reached.
1-18 For each year, up to a maximum of two years, of work experience
1-19 required for certification in a vocational field, a vocational
1-20 teacher who is certified in that field is entitled to salary step
1-21 credit as if the work experience were teaching experience.

5-21 (f) Each person employed in the public schools of this state
5-22 who is an educational aide, teacher trainee, or nondegree teacher
5-23 or who is assigned to a position classified as professional under
5-24 the Texas Public Education Compensation Plan must be certified
5-25 according to the certification requirements or standards for each
5-26 position as established by rule adopted by the State Board of
5-27 Education. However, additional certification may not be required
6-1 of a person holding a valid state license as a speech language
6-2 pathologist or audiologist. Persons other than those holding such
6-3 a license may only be employed to render such services if an
6-4 acceptable licensed applicant is not available.
6-5 (i) Beginning with an employee's second year at step 20 and
6-6 for 10 years thereafter, the employee shall be paid not less than
6-7 the monthly base salary prescribed by the applicable salary
6-8 schedule under Subsection (c), plus $550 more than the employee's
6-9 salary for the preceding year for an employee with a professional
6-10 class title or $225 more than the employee's salary for the
6-11 preceding year for an employee with a paraprofessional class title.
6-12 For each year of employment after that period, each employee shall
6-13 be paid not less than the employee's salary for the preceding year.
6-14 SECTION 2. Chapter 16, Education Code, is amended by adding
6-15 Sections 16.057 and 16.0571 to read as follows:
6-16 Sec. 16.057. INSTRUCTIONAL SUPPORT STIPENDS. (a) Beginning
6-17 with the fourth year of experience as a professional employee of a
6-18 school district in this state as described under Section 16.056(d),
6-19 a school district may assign a professional employee to an
6-20 instructional support duty.
6-21 (b) For purposes of this section, an instructional support
6-22 duty includes assignment as a mentor teacher, student teacher
6-23 supervisor, peer growth counselor, grade-level leader, lead
6-24 teacher, team leader, department chair, in-service staff
6-25 development trainer, academic club sponsor, academic decathlon
6-26 sponsor, instructional supervisor, and any other assignment the
6-27 commissioner of education or board of trustees of the district
7-1 identifies as an instructional support duty.
7-2 (c) In addition to any other compensation a school district
7-3 pays the employee, a professional employee assigned to an
7-4 instructional support duty shall be paid not less than $150 per
7-5 month for each duty assigned for the period assigned.
7-6 (d) A teacher assigned to an instructional support duty is
7-7 entitled to maintain classroom teaching duties for at least 75
7-8 percent of the school year based on a daily schedule determined by
7-9 the teacher and campus principal. That right may be waived only by
7-10 the teacher and only to the extent that the teacher's classroom
7-11 duties are reduced to not less than 50 percent of the school year.
7-12 Sec. 16.0571. CONTINUING EDUCATION STIPENDS. (a) Beginning
7-13 with the fourth year of experience as a professional employee of a
7-14 school district in this state, a professional employee shall be
7-15 paid a level one continuing education stipend on completion of 12
7-16 hours of district-approved higher education course work or 180
7-17 hours of district-approved advanced academic training or an
7-18 equivalent combination so that one semester hour of higher
7-19 education course work is equivalent to 15 hours of advanced
7-20 academic training. A professional employee who completes the
7-21 course work or training described by this subsection shall be paid
7-22 an annual level one stipend by the employing school district for a
7-23 period not to exceed five years of employment after the year in
7-24 which the requirements for a level one stipend are completed, as
7-25 follows:
7-26 (1) $50 per month for a professional employee with a
7-27 bachelor's degree; and
8-1 (2) $100 per month for a professional employee with a
8-2 master's or doctoral degree.
8-3 (b) In addition to a level one stipend, a professional
8-4 employee of a school district shall be paid a level two continuing
8-5 education stipend on completion of 12 hours of district-approved
8-6 higher education course work or 180 hours of district-approved
8-7 advanced academic training beyond those hours completed for a level
8-8 one stipend or an equivalent combination so that one semester hour
8-9 of higher education course work is equivalent to 15 hours of
8-10 advanced academic training. A professional employee who completes
8-11 the course work or training described by this subsection shall be
8-12 paid an annual level two stipend for a period not to exceed five
8-13 years of employment after the year in which the requirements for a
8-14 level two stipend are completed, as follows:
8-15 (1) $100 per month for a professional employee with a
8-16 bachelor's degree; and
8-17 (2) $150 per month for a professional employee with a
8-18 master's or doctoral degree.
8-19 (c) A school district may provide a stipend to a
8-20 professional employee who obtains higher education course work or
8-21 advanced academic training that is not approved by the district.
8-22 (d) A school district shall credit higher education course
8-23 work and advanced academic training obtained toward a continuing
8-24 education stipend by a professional employee while employed in
8-25 another district in this state if the credit hours previously
8-26 obtained relate to the current assignment of the employee and
8-27 training expectations of the district.
9-1 (e) A school district may not require a professional
9-2 employee of a school district to obtain advanced academic credit or
9-3 take higher education course work.
9-4 (f) For purposes of this section, a "professional employee"
9-5 is a school district employee with a professional class title under
9-6 Section 16.056(d).
9-7 SECTION 3. For the 1995-1996 school year, each professional
9-8 and paraprofessional employee of a school district entitled to a
9-9 minimum salary under Section 16.056, Education Code, as amended by
9-10 this Act, shall be assigned to the applicable salary schedule under
9-11 that section at a step on the schedule so that:
9-12 (1) an employee for whom the 1995-1996 school year is
9-13 the first year of employment is placed at step zero;
9-14 (2) each professional employee for whom the 1995-1996
9-15 school year is not the first year of employment is placed at the
9-16 lowest step that provides the employee with a monthly salary that
9-17 is at least $150 more than the employing school district had
9-18 planned in its 1995-1996 school year budget to pay an employee at
9-19 the step to which the employee would have been assigned for the
9-20 1995-1996 school year under the salary schedule prescribed by
9-21 Section 16.056, Education Code, as the schedule existed before
9-22 amendment by this Act; and
9-23 (3) each paraprofessional employee for whom the
9-24 1995-1996 school year is not the first year of employment is placed
9-25 on the lowest step that provides the employee with a monthly salary
9-26 that is at least $50 more than the employee's monthly salary or
9-27 wage for the preceding year.
10-1 SECTION 4. This Act applies beginning with the 1995-1996
10-2 school year.
10-3 SECTION 5. The importance of this legislation and the
10-4 crowded condition of the calendars in both houses create an
10-5 emergency and an imperative public necessity that the
10-6 constitutional rule requiring bills to be read on three several
10-7 days in each house be suspended, and this rule is hereby suspended,
10-8 and that this Act take effect and be in force from and after its
10-9 passage, and it is so enacted.
