    1-1                                AN ACT
    1-2  relating to the certification of certain health organizations to
    1-3  contract with or employ certain health practitioners.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 5.01(b), Medical Practice Act (Article
    1-6  4495b, Vernon's Texas Civil Statutes), is amended to read as
    1-7  follows:
    1-8        (b)  The board shall, on a form and under rules adopted by
    1-9  the board, approve and certify any health organization to contract
   1-10  with or employ physicians licensed by the board upon application by
   1-11  the organization and presentation of satisfactory proof to the
   1-12  board that the organization:
   1-13              (1)  is a nonprofit corporation under the Texas
   1-14  Non-Profit Corporation Act (Article 1396-1.01, Vernon's Texas Civil
   1-15  Statutes) and Section 501(c)(3), Internal Revenue Code;  and
   1-16              (2)  is organized and operated as a migrant, community,
   1-17  or homeless health center under the authority of and in compliance
   1-18  with 42 U.S.C. Section 254b, 254c <254(b) or (c)>, or 256, or as a
   1-19  federally qualified health center under 42 U.S.C.  Section
   1-20  1396d(l)(2)(B) <to contract with or employ physicians licensed by
   1-21  the board>.
   1-22        SECTION 2.  Article 4551n(a), Revised Statutes, is amended to
   1-23  read as follows:
   1-24        (a)  The Board shall, on a form and under rules adopted by
    2-1  the Board, approve and certify any health organization to contract
    2-2  with or employ dentists licensed by the Board on <upon> application
    2-3  by the organization and presentation of satisfactory proof to the
    2-4  Board that the organization:
    2-5              (1)  is a nonprofit corporation under the Texas
    2-6  Non-Profit Corporation Act (Article 1396-1.01 et seq., Vernon's
    2-7  Texas Civil Statutes) and Section 501(c)(3), Internal Revenue Code
    2-8  of 1986 (26 U.S.C. Section 501); and
    2-9              (2)  is organized and operated as a migrant, community,
   2-10  or homeless health center under the authority of and in compliance
   2-11  with 42 U.S.C. Section 254b, 254c, or 256 or as a federally
   2-12  qualified health center under 42 U.S.C.  Section 1396d(l)(2)(B) <to
   2-13  contract with or employ dentists licensed by the Board>.
   2-14        SECTION 3.  The importance of this legislation and the
   2-15  crowded condition of the calendars in both houses create an
   2-16  emergency and an imperative public necessity that the
   2-17  constitutional rule requiring bills to be read on three several
   2-18  days in each house be suspended, and this rule is hereby suspended,
   2-19  and that this Act take effect and be in force from and after its
   2-20  passage, and it is so enacted.
