1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the certification of certain health organizations to
1-9 contract with or employ certain health practitioners.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 5.01(b), Medical Practice Act (Article
1-12 4495b, Vernon's Texas Civil Statutes), is amended to read as
1-13 follows:
1-14 (b) The board shall, on a form and under rules adopted by
1-15 the board, approve and certify any health organization to contract
1-16 with or employ physicians licensed by the board upon application by
1-17 the organization and presentation of satisfactory proof to the
1-18 board that the organization:
1-19 (1) is a nonprofit corporation under the Texas
1-20 Non-Profit Corporation Act (Article 1396-1.01, Vernon's Texas Civil
1-21 Statutes) and Section 501(c)(3), Internal Revenue Code; and
1-22 (2) is organized and operated as a migrant, community,
1-23 or homeless health center under the authority of and in compliance
1-24 with 42 U.S.C. Section 254b, 254c <254(b) or (c)>, or 256, or as a
1-25 federally qualified health center under 42 U.S.C. Section
1-26 1396d(l)(2)(B) <to contract with or employ physicians licensed by
1-27 the board>.
1-28 SECTION 2. Article 4551n(a), Revised Statutes, is amended to
1-29 read as follows:
1-30 (a) The Board shall, on a form and under rules adopted by
1-31 the Board, approve and certify any health organization to contract
1-32 with or employ dentists licensed by the Board on <upon> application
1-33 by the organization and presentation of satisfactory proof to the
1-34 Board that the organization:
1-35 (1) is a nonprofit corporation under the Texas
1-36 Non-Profit Corporation Act (Article 1396-1.01 et seq., Vernon's
1-37 Texas Civil Statutes) and Section 501(c)(3), Internal Revenue Code
1-38 of 1986 (26 U.S.C. Section 501); and
1-39 (2) is organized and operated as a migrant, community,
1-40 or homeless health center under the authority of and in compliance
1-41 with 42 U.S.C. Section 254b, 254c, or 256 or as a federally
1-42 qualified health center under 42 U.S.C. Section 1396d(l)(2)(B) <to
1-43 contract with or employ dentists licensed by the Board>.
1-44 SECTION 3. The importance of this legislation and the
1-45 crowded condition of the calendars in both houses create an
1-46 emergency and an imperative public necessity that the
1-47 constitutional rule requiring bills to be read on three several
1-48 days in each house be suspended, and this rule is hereby suspended,
1-49 and that this Act take effect and be in force from and after its
1-50 passage, and it is so enacted.
