A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the minimum salary of a classroom teacher in public
1-3 schools.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 16.055, Education Code, is amended to
1-6 read as follows:
1-7 Sec. 16.055. Compensation of Professional and
1-8 Paraprofessional Personnel. (a) A school district must pay each
1-9 employee who is qualified for and employed in a position classified
1-10 under the Texas Public Education Compensation Plan set forth in
1-11 Section 16.056 of this chapter not less than the minimum monthly
1-12 base salary, plus, if applicable, increments for <teaching>
1-13 experience, specified for the position.
1-14 (b) Contracts for personnel shall be made on the basis of a
1-15 minimum of 10 months' service, which must include the number of
1-16 days of instruction for students and days of preparation for
1-17 personnel required by Section 16.052 of this code. The days of
1-18 preparation required herein shall be conducted by local boards of
1-19 education under rules and regulations established by the State
1-20 Board of Education that are consistent with the state accreditation
1-21 standards for program planning, preparation, and improvement.
1-22 Personnel employed for more than 10 months shall be paid not less
1-23 than the minimum monthly base pay, plus, if applicable, increments
1-24 for experience, for each month of actual employment. Personnel
2-1 employed for 11 months at pay grades 1-11 must render 202 days of
2-2 service, and personnel employed for 12 months at pay grades 1-11
2-3 must render 220 days of service. Personnel employed for 11 months
2-4 at pay grades 12-18 must render 207 days of service, and personnel
2-5 employed for 12 months at pay grades 12-18 must render 226 days of
2-6 service. However, the number of days of service required by this
2-7 subsection may be reduced by the commissioner under Section
2-8 16.052(c) of this code, and the reduction shall not reduce the
2-9 total salaries of personnel.
2-10 (c) Notwithstanding Subsection (b) of this section, a
2-11 vocational agriculture teacher employed for 12 months shall render
2-12 226 days of service <regardless of pay grade>.
2-13 SECTION 2. Sections 16.056(a), (b), (d), and (h), Education
2-14 Code, are amended to read as follows:
2-15 (a) School district personnel who are qualified for and
2-16 employed in positions described in Subsection (d) of this section
2-17 shall be paid not less than:
2-18 (1) in the case of personnel other than a classroom
2-19 teacher, the monthly base salary, plus increments for <teaching>
2-20 experience, set forth in Subsection (c) of this section, or greater
2-21 amounts provided by appropriation; or
2-22 (2) in the case of a classroom teacher, the minimum
2-23 salary determined under Subsection (h) or a greater amount provided
2-24 by appropriation.
2-25 (b) Each individual, other than a classroom teacher, shall
2-26 advance on the salary schedule under Subsection (c) one step per
2-27 each year of experience until step 10 is reached. <For each year,
3-1 up to a maximum of two years, of work experience required for
3-2 certification in a vocational field, a vocational teacher who is
3-3 certified in that field is entitled to salary step credit as if the
3-4 work experience were teaching experience.>
3-5 (d) The following positions are entitled to the minimum
3-6 monthly salary determined under <set by> Subsection (c) or (h) of
3-7 this section, as applicable, for the number of annual contract
3-8 months specified:

5-4 (h) A classroom teacher who spends at least four hours each
5-5 school day having primary responsibility for teaching students is
5-6 entitled to a minimum monthly salary determined by the formula:
5-7 ((TSF/TADA) x 8) / 10
5-8 where:
5-9 "TSF" is the total amount of funds from the foundation school
5-10 fund paid to school districts in this state under this chapter; and
5-11 "TADA" is the total average daily attendance of school
5-12 districts in this state <In determining the placement of a teacher
5-13 on the salary schedule under Subsection (c) of this section, a
5-14 district shall credit the teacher for each year of experience,
5-15 whether or not the years are consecutive. Notwithstanding the
5-16 provision of this subsection, no teacher shall be placed on the
5-17 salary schedule at a step above the step where the teacher would
5-18 have been placed had that teacher remained in continuous service>.
5-19 SECTION 3. This Act applies beginning with the 1995-1996
5-20 school year.
5-21 SECTION 4. The importance of this legislation and the
5-22 crowded condition of the calendars in both houses create an
5-23 emergency and an imperative public necessity that the
5-24 constitutional rule requiring bills to be read on three several
5-25 days in each house be suspended, and this rule is hereby suspended,
5-26 and that this Act take effect and be in force from and after its
5-27 passage, and it is so enacted.
