                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to prohibiting the registration, sale, use, and
    1-3  application of chlordane; providing a penalty.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter E, Chapter 76, Agriculture Code, is
    1-6  amended by adding Section 76.1011 to read as follows:
    1-7        Sec. 76.1011.  PROHIBITION OF CHLORDANE.  Because of the
    1-8  potential risk to human health, the registration, sale, use, and
    1-9  application by a person of the pesticide chlordane or of a product
   1-10  that contains chlordane is prohibited.
   1-11        SECTION 2.  Section 76.117, Agriculture Code, is amended to
   1-12  read as follows:
   1-13        Sec. 76.117.  PROPERTY OWNER USE.  Except for chlordane or
   1-14  pesticides that contain chlordane, this <This> chapter does not
   1-15  prohibit a property owner from using in the property owner's house,
   1-16  lawn, or garden a pesticide that is labeled for that use, other
   1-17  than a pesticide that may be registered and classified for use only
   1-18  by certified applicators.
   1-19        SECTION 3.  This Act takes effect September 1, 1995, and
   1-20  applies to the registration, sale, use, and application by a person
   1-21  of chlordane or a product that contains chlordane that occurs on or
   1-22  after that date.
   1-23        SECTION 4.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
