                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to deductibles for workers' compensation insurance.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Article 5.55C(a), Insurance Code, is amended to
    1-5  read as follows:
    1-6        (a)  The Board shall require each company or association that
    1-7  writes workers' compensation insurance in this state to provide,
    1-8  upon request, <offer> optional deductible plans that permit <to
    1-9  allow> policyholders to self-insure for the deductible amount.
   1-10        SECTION 2.  Not later than January 1, 1996, the department
   1-11  shall review and analyze the data applicable to the optional
   1-12  deductible plans promulgated under Article 5.55C, Insurance Code,
   1-13  and shall make a recommendation to the commissioner of insurance
   1-14  regarding the amount of the premium reduction allowable for the
   1-15  deductible options.
   1-16        SECTION 3.  Not later than January 1, 1996, the department
   1-17  shall amend the information page of the workers' compensation
   1-18  policy promulgated under Article 5.57, Insurance Code, to contain
   1-19  notice to the policyholder that a deductible option is available
   1-20  under Article 5.55C, Insurance Code, and to notify the policyholder
   1-21  that the policyholder must specifically request the deductible
   1-22  option.
   1-23        SECTION 4.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended,
    2-5  and that this Act take effect and be in force from and after its
    2-6  passage, and it is so enacted.
