                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to purchase or reinstatement of membership service credit
    1-3  in the Teacher Retirement System of Texas.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter A, Chapter 823, Government Code, is
    1-6  amended by adding Section 823.004 to read as follows:
    1-7        Sec. 823.004.  ROLLOVER TO ESTABLISH SERVICE CREDIT.  The
    1-8  board of trustees shall adopt rules to permit the retirement system
    1-9  to accept, on behalf of a member of the retirement system, an
   1-10  eligible rollover distribution under the Internal Revenue Code of
   1-11  1986 (Title 26, United States Code) from an eligible retirement
   1-12  plan other than the retirement system in payment of all or a
   1-13  portion of the amounts required to establish or reinstate
   1-14  membership, military, or equivalent membership service credit in
   1-15  the retirement system for which the member is eligible under other
   1-16  provisions of this subtitle.  An eligible rollover distribution
   1-17  includes a direct trustee-to-trustee transfer from a plan that
   1-18  qualifies under Section 401(a) of the Internal Revenue Code of
   1-19  1986.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
