A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the requirement of separating certain classes of
1-3 inmates in a county jail.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 351.005, Local Government Code, is
1-6 amended to read as follows:
1-7 Sec. 351.005. SEPARATION <SEGREGATION> REQUIREMENTS. A
1-8 county jail must have solid walls constructed of masonry, metal, or
1-9 a comparable material, designed to form separate enclosures to
1-10 separate different classes of inmates housed in the jail as
1-11 required by the facilities classification plan and rules of the
1-12 Commission on Jail Standards <segregate the following classes of
1-13 individuals:>
1-14 <(1) witnesses from all classes of prisoners;>
1-15 <(2) males from females;>
1-16 <(3) juveniles from adults;>
1-17 <(4) first offenders awaiting trial from all classes
1-18 of convicted prisoners; and>
1-19 <(5) prisoners with communicable diseases from all
1-20 other classes of prisoners>.
1-21 SECTION 2. This Act takes effect September 1, 1995.
1-22 SECTION 3. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
