                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of the Texas Transportation Commission to
    1-3  acquire certain real property.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subsection (a), Section 4, Article 6674w-3,
    1-6  Revised Statutes, is amended by adding paragraph (6) to read as
    1-7  follows:
    1-8              (6)  If only a portion of a parcel of land is needed
    1-9  for highway purposes, the commission may, in its discretion,
   1-10  acquire by purchase the entire parcel if the fair market value of
   1-11  the part taken plus damages to the remainder is greater than or
   1-12  equal to the fair market value of the entire parcel.  Any land
   1-13  acquired under this paragraph that is not needed for highway
   1-14  purposes may be leased by the department pursuant to Chapter 757,
   1-15  Acts of the 70th Legislature, Regular Session, 1987 (Article
   1-16  6673a-3, Vernon's Texas Civil Statutes), or may be sold or
   1-17  exchanged pursuant to Chapter 99, General Laws, Acts of the 42nd
   1-18  Legislature, Regular Session, 1931 (Article 6673a, Vernon's Texas
   1-19  Civil Statutes).
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
