By Davila H.B. No. 2255 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to a warning sign at certain tanning facilities. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Chapter 145, Health and Safety Code, is amended 1-5 by adding Section 145.0065 to read as follows: 1-6 Sec. 145.0065. WARNING SIGN: SEXUALLY ORIENTED BUSINESS. A 1-7 tanning facility that operates as a sexually oriented business 1-8 under a license or permit issued in accordance with Section 1-9 243.007, Local Government Code, shall post a warning sign in a 1-10 conspicuous place readily visible to a person entering the 1-11 facility. The sign must have dimensions of at least 12 X 18 inches 1-12 THIS ESTABLISHMENT IS LICENSED AS A SEXUALLY ORIENTED 1-13 BUSINESS. THE PRIMARY SERVICE PROVIDED BY THIS 1-14 ESTABLISHMENT IS NOT TANNING. 1-15 PROSTITUTION AND SOLICITATION OF PROSTITUTION ARE 1-16 CRIMES UNDER THE LAWS OF THIS STATE. 1-17 SECTION 2. (a) This Act takes effect September 1, 1995. 1-18 (b) A tanning facility that is operating on the effective 1-19 date of this Act and that is required to post a sign under Section 1-20 145.0065, Health and Safety Code, as added by this Act, shall post 1-21 the sign not later than September 30, 1995. 1-22 SECTION 3. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended.
