A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the types of permit or license which may be held by a
1-3 wine only package store permittee.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 24.05, Alcoholic Beverage Code, is
1-6 amended to read as follows:
1-7 Sec. 24.05. Prohibited Interests. (a) No person who holds
1-8 a wine only package store permit or owns an interest in a wine only
1-9 package store may have a direct or indirect interest in any of the
1-10 following:
1-11 (1) a manufacturer's<, retail dealer's on-premise,> or
1-12 general, branch, or local distributor's license;
1-13 (2) <a wine and beer retailer's or wine and beer
1-14 retailer's off-premise permit; or>
1-15 <(3)> the business of any of the <permits or> licenses
1-16 listed in Subdivision <Subdivisions> (1) <and (2)> of this
1-17 subsection <section>.
1-18 (b) A person may hold both a wine only package store permit
1-19 and a retail dealer's off-premise license.
1-20 (c) A person may not hold a wine and beer retailer's or wine
1-21 and beer retailer's off-premise permit at the same location where
1-22 the person holds a wine only package store permit.
1-23 SECTION 2. The importance of this legislation and the
2-1 crowded condition of the calendars in both houses create an
2-2 emergency and an imperative public necessity that the
2-3 constitutional rule requiring bills to be read on three several
2-4 days in each house be suspended, and this rule is hereby suspended.
