1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the types of permit or license which may be held by a
1-9 wine only package store permittee.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 24.05, Alcoholic Beverage Code, is
1-12 amended to read as follows:
1-13 Sec. 24.05. Prohibited Interests. (a) No person who holds
1-14 a wine only package store permit or owns an interest in a wine only
1-15 package store may have a direct or indirect interest in any of the
1-16 following:
1-17 (1) a manufacturer's<, retail dealer's on-premise,> or
1-18 general, branch, or local distributor's license;
1-19 (2) <a wine and beer retailer's or wine and beer
1-20 retailer's off-premise permit; or>
1-21 <(3)> the business of any of the <permits or> licenses
1-22 listed in Subdivision <Subdivisions> (1) <and (2)> of this
1-23 subsection <section>.
1-24 (b) A person may hold both a wine only package store permit
1-25 and a retail dealer's off-premise license.
1-26 (c) A person may not hold a wine and beer retailer's or wine
1-27 and beer retailer's off-premise permit at the same location where
1-28 the person holds a wine only package store permit.
1-29 SECTION 2. The importance of this legislation and the
1-30 crowded condition of the calendars in both houses create an
1-31 emergency and an imperative public necessity that the
1-32 constitutional rule requiring bills to be read on three several
1-33 days in each house be suspended, and this rule is hereby suspended.
