A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the authority of a county clerk to waive or reduce the
1-3 fee imposed for copies of certain documents.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 118.0145, Local Government Code, is
1-6 amended to read as follows:
1-7 Sec. 118.0145. Noncertified Papers. (a) The fee for
1-8 "Noncertified Papers" under Section 118.011 is for issuing a
1-9 noncertified copy of each page or part of a page of a document.
1-10 The fee must be paid at the time the order is placed.
1-11 (b) A county clerk may waive or reduce the fee provided in
1-12 Section 118.011 for issuing a noncertified copy of a page or a
1-13 portion of a page of a document if the document:
1-14 (1) involves a matter relating to family law,
1-15 including a divorce decree; or
1-16 (2) is the record of a judgment in a misdemeanor case.
1-17 SECTION 2. The importance of this legislation and the
1-18 crowded condition of the calendars in both houses create an
1-19 emergency and an imperative public necessity that the
1-20 constitutional rule requiring bills to be read on three several
1-21 days in each house be suspended, and this rule is hereby suspended,
1-22 and that this Act take effect and be in force from and after its
1-23 passage, and it is so enacted.
