No. 2272 74R6314 DWS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to disclosure by a used car dealer of the consideration 1-3 the dealer paid for a used car; providing a penalty. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 17, Business & Commerce Code, is amended 1-6 by adding Subchapter I to read as follows: 1-7 SUBCHAPTER I. SALE OF USED MOTOR VEHICLES 1-8 Sec. 17.901. DISCLOSURE OF TITLE INFORMATION. (a) In this 1-9 section: 1-10 (1) "Passenger car" has the meaning assigned by 1-11 Section 2(j), Uniform Act Regulating Traffic on Highways (Article 1-12 6701d, Vernon's Texas Civil Statutes). 1-13 (2) "Used car dealer" means a person, corporation, or 1-14 association in the business of selling used passenger cars. 1-15 (b) Before a used car dealer sells a used passenger car, the 1-16 used car dealer shall provide the buyer a written notice disclosing 1-17 the consideration paid by the used car dealer to obtain the used 1-18 passenger car. 1-19 (c) A used car dealer commits an offense if the used car 1-20 dealer does not provide a notice as required by this section or 1-21 provides a notice containing false or misleading information. An 1-22 offense under this subsection is a Class C misdemeanor. 1-23 SECTION 2. This Act takes effect September 1, 1995, and 1-24 applies only to a sale of a used passenger car occurring on or 2-1 after that date. 2-2 SECTION 3. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended.
