By Carona H.B. No. 2285 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the demolition of a public building in certain 1-3 municipalities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subtitle A. Title 9, Local Government Code, is 1-6 amended by adding Chapter 282 to read as follows: 1-7 CHAPTER 282. DEMOLITION OF PUBLIC BUILDINGS IN 1-8 CERTAIN MUNICIPALITIES 1-9 Sec. 282.001. DEFINITION. In this section, "public 1-10 building" includes a civic center, civic center building, arena, 1-11 auditorium, opera house, music hall, exhibition hall, coliseum, 1-12 museum, library, or recreational building or facility. 1-13 Sec. 282.002. APPLICABILITY. This chapter applies only to a 1-14 municipality with a population of more than 1 million that has a 1-15 city manager form of government. 1-16 Sec. 282.003. ELECTION REQUIRED FOR DEMOLITION OF CERTAIN 1-17 PUBLIC BUILDINGS. (a) Except as provided by Subsection (b), a 1-18 municipality may not demolish a public building if municipal debt 1-19 created to finance the construction of the building remains 1-20 outstanding or is transferred to any other public building. 1-21 (b) A municipality may demolish a public building for which 1-22 outstanding municipal debt remains if, at a prior election held in 1-23 the municipality, a majority of the votes cast approve the 2-1 demolition of the building. 2-2 SECTION 2. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended, 2-7 and that this Act take effect and be in force from and after its 2-8 passage, and it is so enacted.
