H.B. No. 2289
    1-1                                AN ACT
    1-2  relating to the representation of certain indigent persons by
    1-3  public defenders in Wichita County.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article 26.043(g), Code of Criminal Procedure, is
    1-6  amended to read as follows:
    1-7        (g)  The public defender or an assistant public defender:
    1-8              (1)  shall represent each indigent person in Wichita
    1-9  County who is:
   1-10                    (A)  charged with a criminal offense in the
   1-11  county; or <Wichita County and>
   1-12                    (B)  a <each indigent> minor who is a party to a
   1-13  juvenile delinquency proceeding in the county; and
   1-14              (2)  may represent each indigent person in Wichita
   1-15  County who is entitled to representation under:
   1-16                    (A)  Chapter 462, Health and Safety Code;
   1-17                    (B)  Subtitle C, Title 7, Health and Safety Code;
   1-18  or
   1-19                    (C)  Subtitle D, Title 7, Health and Safety Code.
   1-20        SECTION 2.  This Act takes effect September 1, 1995.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
