                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the disapproval of a subdivision by a municipality.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 212.009(a), Local Government Code, is
    1-5  amended to read as follows:
    1-6        (a)  The municipal authority responsible for approving plats
    1-7  shall act on a plat within 30 days after the date the plat is
    1-8  filed.  A plat is considered approved by the municipal authority
    1-9  unless it is disapproved for cause within that period.
   1-10        SECTION 2.  The change in law made by this Act applies only
   1-11  to a plat for a subdivision filed with a municipality on or after
   1-12  the effective date of this Act.  A plat filed with a municipality
   1-13  before the effective date of this Act is governed by the law in
   1-14  effect when the plat was filed, and the former law is continued in
   1-15  effect for that purpose.
   1-16        SECTION 3.  This Act takes effect September 1, 1995.
   1-17        SECTION 4.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
